StayGray – Terms of Use

These Terms of Use govern your use of the mobile application "StayGray" (the App) and the optional premium service "StayGray Plus" (Plus). By installing or using the App, you agree to these Terms.

Imprint and Privacy

Our Imprint (as required by § 5 DDG) and our Privacy Policy are available on our website and in the App under "Settings" or a similar section. The Imprint includes provider name and address, email contact, and, where applicable, VAT ID and register details.

1. Definitions

  • App: the iOS application StayGray, including all content, software, and services.
  • Plus: the optional paid service (available as a subscription or one-time purchase) that unlocks additional features.
  • We or us: the Provider named above.
  • You: the end user of the App.

2. Pre-Contract Information and Conclusion of Contract

App download: The App is distributed via the Apple App Store. The download contract is concluded when Apple confirms the download.

Plus purchase: The contract for Plus is concluded when Apple confirms your in-app purchase (subscription or one-time) using your Apple ID. Your service contract for Plus access is with us.

Availability of Terms: The Terms are available in the App and on our website.

Languages: Available in English, German, Spanish, Swedish, Finnish, French, Japanese, Portuguese (Brazil), Portuguese (Portugal), Dutch, and Danish. If your device language is not one of these, English is used.

System requirements: Requires an Apple ID, internet access, and a supported iOS version. Delivery is immediate after download or purchase.

3. Scope of License and User Rights

We grant a limited, nonexclusive, nontransferable, revocable license to use the App for personal, noncommercial purposes. All intellectual property remains with us and our licensors. Use is permitted only on Apple-branded devices you own or control, as allowed by Apple's Usage Rules.

Plus purchases are not eligible for Family Sharing unless we explicitly enable it (check the App Store product page details).

4. Account, Eligibility, and Age

You must be at least 16 years old to use the App. If you are under the age of majority where you live, a parent or guardian must review and accept these Terms and make any purchases. If local law requires a higher minimum age, that higher age applies.

5. Acceptable Use

You agree not to:

  • Copy, modify, translate, reverse engineer, or disassemble the App, except as permitted by law
  • Use the App in violation of law or third-party rights
  • Upload malware or interfere with the App or our systems
  • Circumvent access controls
  • Use the App commercially without our written consent

6. No Medical Advice

StayGray is a utility tool designed to help manage screen time and color usage. It is not a medical device and does not provide medical or psychological advice. It is not a substitute for professional diagnosis or treatment.

7. Features

{The Free tier includes core functionality to toggle grayscale. StayGray Plus unlocks:}

  • Statistics: Detailed insights on your color usage (when, how long, and why you take breaks from grayscale)
  • Automation Guides: Setup guides to reduce manual switching
  • Advanced Settings: Customization of available times and reasons for color breaks
  • Tips and Tricks: Content to help reduce screen time through grayscale
  • Any other Plus features shown at the time of purchase

8. Prices and Regional Availability

Prices for Plus are set in Germany and localized by Apple. The price shown at checkout is final, including taxes.

Reference prices in Germany:

  • Monthly Subscription: €2.99
  • Yearly Subscription: €12.99
  • One-Time Purchase (Lifetime): €24.99

Prices may change for subscriptions at renewal (see Section 11). The One-Time Purchase is a single upfront payment for the lifetime of the App's availability.

9. Purchase, Renewal, and Cancellation for Plus

Subscriptions (Monthly/Yearly):

  • Payment is charged to your Apple ID at confirmation
  • Renew automatically unless cancelled at least 24 hours before the end of the current period
  • Manage or cancel under iOS Settings → your name → Subscriptions
  • If cancelled, Plus remains active until the period ends

One-Time Purchase (Lifetime):

  • Payment is charged once to your Apple ID at confirmation
  • This grants indefinite access to Plus features for as long as the App is supported and available on the App Store
  • This is not a recurring subscription and does not require cancellation

{General: Apple is the merchant of record and handles billing, taxes, and refunds. Your service contract for Plus features is with us.}

10. Billing Grace Period (Subscriptions Only)

For subscriptions, Apple may apply a grace period if billing fails. Plus access continues during this period. If payment fails by the end, access pauses until payment succeeds. This does not apply to One-Time Purchases.

11. Price Changes and Renewals

Subscriptions: Prices may change at renewal. Apple manages these changes and notifies you according to its rules. You can cancel anytime before renewal in iOS Settings.

One-Time Purchase: The price is fixed at the moment of purchase. Future price changes for new users do not affect you.

12. Refunds

Refunds are handled by Apple under the Apple Media Services Terms. Use Apple's "Report a Problem" process to request refunds. We do not issue refunds directly.

13. Entitlements, Restoration, and Devices

RevenueCat is used to validate purchases and manage entitlements. Plus access is tied to your Apple ID and can be restored in the App using the "Restore Purchases" button. There is no device limit for your Apple ID.

14. Updates, Modifications, and Legal Guarantee

We provide updates (including security updates) necessary to keep the App and Plus functional. You must install available updates. We may modify features for valid reasons such as legal or performance needs. If the App or Plus is nonconforming, we will fix it or you may be entitled to a reduction or termination under sections 327 et seq. BGB.

15. Data, Privacy, and Security

Processing is described in our Privacy Policy. RevenueCat processes subscription data as our processor under Article 28 GDPR. Usage statistics and settings are stored locally on your device or in your personal iCloud. We do not transmit this personal usage data to our servers.

16. Data After Cancellation or Lapse of Plus

If your subscription ends (or is not renewed):

  • Your account reverts to the free tier
  • Access to detailed statistics, advanced settings, and automation guides will be locked
  • Your historical data remains on your device/iCloud but may not be fully viewable until you re-subscribe
  • Deleting the App removes data from the device but not from device or iCloud backups

17. Third Party Services and Links

We are not responsible for third party content or services. Their use may be subject to separate terms and privacy policies.

18. Availability and Maintenance

We aim to keep the App and Plus available but outages may occur due to maintenance or events beyond our control (power failures, disasters, App Store outages, etc.).

19. Liability Under German Law

We are fully liable for intent, gross negligence, injury to life or health, and under the Product Liability Act. For simple negligence, liability applies only to essential duties and is limited to foreseeable, typical damage. Otherwise, liability is excluded.

20. Termination and Suspension

We may suspend or restrict access to comply with law, prevent fraud, or protect system integrity. If Plus is discontinued entirely during a paid subscription period, your statutory remedies apply.

21. Export Control and Sanctions

You confirm you are not in a country subject to U.S. embargo and not listed on U.S. prohibited or restricted party lists.

22. Changes to These Terms

We may update these Terms. If a change significantly reduces paid features, you may cancel Plus before renewal. The current version is always available in the App and on our website.

23. Governing Law, Venue, and Consumer Rights

German law applies. For non-consumers or users without a German jurisdiction, venue is Amtsgericht Hildesheim. Consumers retain mandatory rights under the law of their country of residence. We are not obliged or willing to participate in consumer dispute resolution proceedings.

24. Miscellaneous

  • Assignment: You may not assign rights or obligations without our consent
  • Severability: Invalid provisions do not affect the rest
  • No waiver: Failure to enforce a right is not a waiver
  • Force majeure: We are not responsible for delays caused by events beyond control
  • Language and precedence: Versions exist in several languages; for consumers, the version most favorable to them prevails. For German consumers, the German version prevails; otherwise, English prevails
  • Entire agreement: These Terms, the Privacy Policy, and any in-App notices form the complete agreement

25. Apple Platform Terms

  • Acknowledgement: This agreement is between you and us, not Apple
  • Scope of license: Non-transferable license for Apple-branded devices you own or control
  • Maintenance and support: We are responsible; Apple has no obligation
  • Warranty: We handle warranties. Apple may refund the purchase price if applicable
  • Product claims: We are responsible for product and legal claims
  • Intellectual property rights: We handle any third-party IP claims
  • Legal compliance: You confirm you are not subject to U.S. embargo or listed restrictions
  • Developer: Matthias Neuwirth-Trapp, Vogelweide 29, 31137 Hildesheim, Germany
  • Third party terms: You must comply with third-party agreements (for example, wireless provider terms)
  • Third party beneficiary: Apple and its subsidiaries are third party beneficiaries of this agreement

26. Support and Contact

Support is available in English and German at contact@staygray.app. We aim to reply within 2 business days, but response times may vary. Subscription cancellations must be managed through Apple in iOS Settings.

Appendix A – Model Withdrawal Form (EU and UK Consumers)
